  • Christian Ethical Standards — Users must conduct their activities on the Site and its Services in compliance with all applicable laws and ethical standards consistent with our Reformed Christian values, including, but not limited to, loving God with all your heart, mind, and soul; and love your neighbor as yourself.

Sharing or selling your account, or any of its benefits, constitutes a violation of these terms. The registered account holder is responsible for the actions of any individual they grant access to their account, intentionally or unintentionally, in breach of this contract.

c. Termination and Suspension

  • Reasons for Termination or Suspension — The Company reserves the right to suspend or terminate your account if you:

    • Violate these Terms of Service or any other policies posted on the Site.

    • Engage in activities that are unlawful or fraudulent.

The absence of a trademark or copyright symbol does not imply that such marks or the material associated with them are not protected by intellectual property laws.

  • Unique, made-to-order products — All products sold through the Services are unique, made-to-order items. As such, when you order a particular size and color, it’s possible you own the only example of that design in the world.

b. Order Processing & Holidays

  • Initial Review: The initial placement of an order does not guarantee that the order will be processed. We reserve the right to review any and all orders. We may contact you for additional details and clarifications to ensure the accuracy and feasibility of the order.

  • Standard Processing: Most orders are processed and shipped within 7 business days.

  • Holiday Seasons: During peak seasons like Mother’s Day, Father’s Day, and Christmas, allow up to 14 business days for processing. Plan accordingly to ensure timely delivery.

c. Cancelling Orders

  • Cancellation Rights: We reserve the right to cancel any order at any stage of the order process, with or without cause. This includes situations where we suspect fraud, encounter supply issues, or if errors occur in the ordering information provided.

  • Refund Policy: In the event of cancellation by us for reasons other than customer error or fraud, a full refund will be issued in accordance with applicable law. However, if an order is cancelled due to incorrect information provided by the customer, or if cancellation is requested by the customer after the order has been processed or shipped, we may withhold refunds based on costs incurred or the inability to halt production.

d. Returns and Refunds

  • Limited returns — Due to the unique nature of our made-to-order products, returns and refunds are not available if you order the wrong size, color, change your mind, or decide after the fact that you do not like the product.

  • Remedies for faulty products — In the case of a damaged product, a manufacturing error, or receiving the wrong item due to an error on our part, HumblePray offers a free replacement or a refund. You must contact us within 30 days of product delivery. Do not return the product unless or until requested by a customer service representative.

e. Exclusive Designs

  • Exclusive Offerings Defined — We use the terms “Exclusive offerings”, “Exclusive designs”, and “Exclusive products” to denote products featuring a unique arrangement of graphical, textual, aesthetic elements, or any combination thereof, sold solely by our company. These products may incorporate elements or inspirations from existing designs under license, but are uniquely transformed and adapted for exclusive sale in our store.

f. Limited Edition

  • Definition and Criteria — Products labeled as “Limited Edition” or “LTE” are produced in restricted quantities. These limits are set based on various factors including sales data, anticipated demand, and the value our customers attribute to these products.

  • Flexibility in Production — We reserve the right to adjust the limits of these products at our discretion to balance exclusivity with customer demand. Changes in production limits may occur without prior notice.

  • Product Design Continuity — “Limited Edition” refers to the specific composition of a design applied to a particular product. Similar or exact designs may be utilized on different products or versions of the same product, with or without modification.

  • Design Evolution — Designs from Limited Edition products may be adapted or reimagined for future products, potentially leading to new variations that may resemble original versions.

  • Adjustments to Product Limits — Changes in the quantity of any Limited Edition product—whether an increase or a decrease—are at our discretion and will not affect the purchase terms post-sale. Such adjustments do not constitute grounds for returns or refunds, as the exclusivity of the product does not directly correlate to its price.

g. Subscriptions and Downloadable Content

Downloadable Content

  • Non-Transferable: All downloadable content is for personal use only and is non-transferable. It is not for resale.

  • Non-Commercial Use: All content, unless otherwise noted, is sold under a non-commercial license. If you are interested in commercial usage of our content, please contact us.

Subscriptions

  • Non-Refundable: All subscription purchases are final and non-refundable.

  • Unsubscribing: Users may unsubscribe at any time. Subscriptions will end at the next billing cycle following the unsubscribe request.

  • Substack Paid Subscription Syncing: Subscriptions do not automatically link between Substack and our website. We will sync premium subscriptions to Substack (or vice versa) upon request, provided the subscription email addresses are identical.

VI. Shipping Policy

a. Shipping Options and Costs

  • Variety of Options: We offer various shipping options, including Standard and Express Delivery.

  • Calculation of Costs: Shipping costs are calculated based on the selected method, weight, dimensions of the items, and destination.

  • Display of Costs: Total shipping costs will be clearly displayed at checkout.

  • Shipping Regions: We currently ship only to the US and Canada.

b. Shipping Information and Guidelines

  • Accurate Information Required: It is the customer’s responsibility to ensure that all shipping addresses are provided in Latin characters and are accurate and complete. We do not provide address validation services. Incorrect, incomplete, or erroneous shipping information may lead to order cancellation or delivery failures.

  • PO Box Restrictions: Express Delivery is not available for PO box addresses. Orders specifying a PO box for Express Delivery will be automatically canceled and refunded.

  • PO Box Formatting: For standard shipping to a PO box, adhere to the formatting guidelines provided.

  • Home Delivery Requirements: For successful home delivery, ensure full and accurate details are provided, including recipient’s name, street address, apartment number, and zip code. Incomplete information may result in non-delivery.

  • Additional Fees: Even when free shipping is available, additional fees brought about by the shipping location, such as duties and taxes, will be the responsibility of the customer.

c. Risk of Loss and Tracking

  • Risk of Loss: All purchases are made pursuant to a shipment contract. The risk of loss and title for items pass to you upon our delivery to the carrier.

  • Tracking Your Order: You will receive a shipment confirmation email with a tracking number once your order has shipped. The tracking number will be active within 24 hours.

d. Shipping Delays and Carrier Issues

  • Carrier Delays: We are not responsible for delays caused by shipping carriers due to weather conditions, system failures, or other factors beyond our control.

legal disputes arising from or related to the website or the services, such disputes shall be resolved exclusively in the federal or state courts located in Michigan. You agree to the personal jurisdiction and venue in these courts.

X. Dispute Resolution

a. Arbitration Agreement

  • Mandatory Arbitration: You agree that any dispute, claim, or controversy arising out of or relating to your use of our services or products, or the breach, termination, enforcement, interpretation, or validity of these Terms of Service, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Oakland County, Michigan, except as described below.

  • Arbitration Procedures: The arbitration will be conducted in the English language by a single arbitrator agreed upon by both parties. If the parties are unable to agree on an arbitrator, an arbitrator will be appointed by a judge of the district court of Oakland County. The arbitration will be conducted in accordance with the rules of the American Arbitration Association (AAA) that are in effect at the time the arbitration is initiated.

  • Exclusions from Arbitration: Any claim related to the infringement or validity of your or HumblePray’s intellectual property rights is not subject to arbitration and may, instead, be adjudicated in the courts of Oakland County, Michigan.

  • Waiver of Class Actions: You and HumblePray agree that any arbitration will be conducted in your individual capacities only and not as a class action or other representative action. You expressly waive your right to file a class action or seek relief on a class basis.

  • Costs of Arbitration: Each party will be responsible for its own costs of arbitration, including legal fees.
